General
You may
not use the Services until you have read this Agreement and
indicated your unconditional acceptance of it by clicking the
'I agree' button. By clicking the 'I agree' button, you are indicating your agreement to be bound by these terms of use as such terms may be modified from time to time. If you do not agree to these Terms of Use, please do not register for, enter or purchase usavis.org As used in this Agreement, the terms you,
your or user are synonymous, and refer to the person using the service.
Services in any way. A registered user is a user from whom
usavis.org has received the information
necessary to permit such person to print prepared immigration
forms by using the Services and who complies with the terms
and conditions of this Agreement.
usavis.org
service and sites are accessible worldwide to anyone with
Internet access. Access to and use of the Services and the
Sites are subject to the terms and conditions of this
agreement including all terms of use and copyright notice and
all applicable laws and regulations, including laws and
regulations governing copyright and trademark. BY ACCESSING
THE SERVICE AND THE SITES, YOU ACCEPT, WITHOUT LIMITATION OR
QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS
AGREEMENT. usavis.org and its affiliates
reserve the right to change these terms and conditions at any
time in their sole discretion. The changes will appear on this web page, and shall be incorporated in this Agreement. By using the
Service and the Sites, you agree in advance to accept any
changes. Your continued use of usavis.org services will signify your acceptance of any change in the terms and conditions set forth herein.
From time to time usavis.org may supplement these Terms of Use with additional terms pertaining to specific services, content or events, ("Additional Terms"), which Additional Terms may be placed on the Site or usavis.org Members Area to be viewed in connection with the specific content or events and shall be identified as such. You understand and agree that such Additional Terms are hereby incorporated by reference into these Terms of Use.
Important Notice
Please take notice that USAVIS.ORG is a private corporation and is not an official organ of the US Government.
Please take notice that at any time, and upon the approval of the US Congress, the US Government has the authority to cancel the Lottery Visa Program, and neither usavis.org nor its affiliates shall have any liability thereto and no refunds shall be given.
Limited warranty
The
Service and the Sites contain information, facts and opinions
from various individuals and organizations. THE SERVICE AND
THE SITES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES
OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT
LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER
THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF
EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS
APPLICABLE TO THIS AGREEMENT. NEITHER usavis.org.
NOR ITS AFFILIATES ENDORSE OR ARE RESPONSIBLE FOR THE ACCURACY
OR RELIABILITY OF ANY OPINION, ADVICE OR STATEMENT ON THE
SERVICE OR THE SITES.
usavis.org MAKES NO WARRANTY THAT THE SERVICES AND SITES WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES AND SITES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES usavis.org MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES AND SITES.
You
acknowledge that the operation and availability of the
communications systems used for accessing and interacting with
the Services (e.g., the public telephone, computer networks
and the Internet) or to transmit information to the
immigration authorities can be unpredictable and may, from
time to time, interfere with or prevent access to services or
their operation. usavis.org is not in any
way responsible for any such interference with or prevention
of your use of or access to services.
Except to the extent of the limited warranty (of calculation
accuracy) described above, the entire liability of
usavis.org
for any reason shall be limited to the amount paid by you for
the Services licensed from usavis.org. To
the maximum extent permitted by applicable law, usavis.org
are not liable for any indirect, special, incidental, or
consequential damages (including damages for loss of
immigration status, deportation, or the like), Whether based
on breach of contract, breach of warranty, tort (including
negligence), product liability or otherwise, even if
usavis.org
have been advised of the possibility of such damages and even
if a remedy set forth herein is found to have failed of its
essential purpose.
The
limitations of damages or liability set forth in this
Agreement are fundamental elements of the basis of the bargain
between usavis.org and you.
You acknowledge and agree that usavis.org
would not be able to provide this product on an economic basis
without such limitations.
Own risk
usavis.org MAKES NO WARRANTY THAT THE SERVICES OR SITES WILL MEET YOUR REQUIREMENTS, OR THAT THE MEMBER SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES usavis.org MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES OR SITES.
Your use of the Service and the Sites is at your own risk.
NEITHER usavis.org SHALL BE LIABLE TO YOU OR
ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT,
INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR
DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR
INABILITY TO ACCESS OR USE, THE SERVICE AND THE SITES AND THE
INFORMATION AVAILABLE ON THE SERVICE AND THE SITES OR ARISING
OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY
INFORMATION AVAILABLE ON THE SERVICE AND THE SITES. YOU HEREBY
WAIVE ANY AND ALL CLAIMS AGAINST usavis.org,
AND ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS,
REPRESENTATIVES AND LICENSORS ARISING OUT OF YOUR USE OF THE
SERVICE AND THE SITES AND THE INFORMATION AVAILABLE THEREON.
WITHOUT DEROGATING FROM THE GENERALITY OF THE ABOVE, usavis.org WILL NOT BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, WHETHER FORSEEABLE OR NOT, WHICH MAY RESULT FROM THE UNAVAILABILITY OR MALFUNCTION OF THE SERVICE AND THE SITES.
Information you post
Any communication or material you post or transmit to the
Service and/or the Sites is, and will be treated as,
non-confidential and non-proprietary. You assume full
responsibility for anything you post or transmit, and you
grant usavis.org and its affiliates the
right to edit, copy, publish and distribute any information or
content you post or transmit for any purpose.
usavis.org and its
affiliates do not review or monitor any web sites linked to
the Service and the Sites and are not responsible for the
content of any such linked web sites. Your linking to such web
sites is at your own risk.
You should be aware that if you voluntarily disclose personal
information (e.g., user name, email address) on a bulletin
board, chat room or on any other user or member generated
pages, that information can be collected and used by others
and may result in unsolicited messages from other parties.
The Service and the Sites include bulletin boards, chat rooms
and other user and member created pages which allow you and
other users and members to post information, provide feedback
to usavis.org and its affiliates, and
interact in real-time. You agree not to post or transmit any
unlawful, harmful, threatening, abusive, harassing,
defamatory, vulgar, obscene, profane, sexually oriented, hateful, racially,
ethnically or otherwise objectionable material of any kind,
including, but not limited to, any material which encourages
conduct that would constitute a criminal offense, violate the
rights of others, or otherwise violate any applicable local,
state, national or international law. You will be responsible
for, and indemnify and hold harmless usavis.org
its subsidiaries, divisions, affiliates, agents and
representatives against, any claim arising from any material
that you post or transmit. Although usavis.org
and its affiliates may from time to time monitor or review
discussions, chats, postings, transmissions, bulletin boards
and other user and member generated pages on the Site, neither
usavis.org nor its affiliates is under any
obligation to do so. You acknowledge that usavis.org
and its affiliates do not control the information available on
the bulletin boards, chat rooms and other user and member
generated pages and that any opinions, advice, statements,
services, offers or other information or content presented or
disseminated on any bulletin board, chat room or on any other
user or member generated pages are those of their respective
authors who are solely liable for their content. usavis.org
and its affiliates reserve the right, in their sole
discretion, to edit, refuse to post or remove any material
submitted to or posted on the chat rooms, bulletin boards or
on any other user or member generated pages.
, however, neither usavis.org nor its affiliates is under any obligation to do so.
Any use by you of any other subscriber's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing) is prohibited. Any such use shall be deemed to be a violation of these Terms of Use. usavis.org services are to be used by you for your personal use only. Commercial uses of the services are strictly prohibited unless prior written consent from usavis.org has been granted. You agree that you will not use the services for chain letters, junk mail, 'spamming,' solicitations (commercial or non-commercial) or bulk communications of any kind including but not limited to distribution lists to any person who has not given specific permission to be included in such a list.
You agree not to post or use usavis.org services to distribute or send any illegal material of any kind, including but not limited to, illegal material in the form of text, graphics, video, programs or audio. Posting content or participating in any form of discussion with the intention to commit any illegal activity is strictly prohibited.
Security
Your usavis.org Account Information is
password-protected for your privacy and security. In certain
areas usavis.org uses industry-standard
SSL-encryption to protect data transmissions.
Confidential Information
Please note that, with the exception of credit card numbers,
usavis.org does not want to receive
confidential or proprietary information from you through our
Web site. Any non-personal information or material sent to
usavis.org will be deemed NOT to be
confidential. By sending usavis.org any
non-personal information or material, you grant usavis.org
an unrestricted, irrevocable license to use, reproduce,
display, perform, modify, transmit and distribute those
materials or information, and you also agree that
usavis.org
is free to use any ideas, concepts, know-how or techniques
that you send us for any purpose. However, usavis.org
will not release your name or otherwise publicize the fact
that you submitted materials or other information to us
unless: (a) you grant us permission to do so; (b)
usavis.org
first notify you that the materials or other information you
submit to a particular part of a site will be published or
otherwise used with your name on it; or (c) to the extent necessary to comply with applicable laws, police investigations, or in legal proceedings where such information is relevant. In addition, you agree that usavis.org may assign, sell, license, or otherwise transfer to a third party, your name, address, e-mail address and any other personal information in connection with an assignment, sale, joint venture, or other transfer or disposition of a portion or all of the assets or stock of usavis.org or its affiliates.
By submitting content, to any Service and the Sites, including message boards, forums and chat rooms, you grant usavis.org and its affiliates a royalty-free, perpetual, irrevocable, non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any copyrights, trademarks and other intellectual and proprietary rights ("Rights") that may exist in such content. You also warrant that the holder of any Rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. You also permit any subscriber to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on any Service and the Sites retains any and all Rights that may exist in such content.
Third Party Services
You may order services or merchandise through Service and the Sites from other persons not affiliated with usavis.org ("Seller"). All matters concerning the merchandise and services desired from Seller, including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance and delivery, are solely between you and Seller. usavis.org makes no warranties or representations whatsoever with regard to any goods or services provided by Sellers. You will not consider usavis.org nor will usavis.org be construed as a party to such transactions, whether or not usavis.org may have received some form of revenue or other remuneration in connection with the transaction or be liable for any costs or damages arising out of, either directly or indirectly, you or any other person involved or related to the transaction.
Your responsibility
It is your responsibility to provide ALL the requirements
listed on time. usavis.org cannot guarantee
to notify all applicants who are missing items.
Fees & refund policy
usavis.org is a private company and if you select to hire usavis.org services to submit your application your fee will be applied towards covering usavis.org's costs and time in handling and submitting your application.
Refunds will be given at the sole discretion of the usavis.org
Management. Fee paid is NOT recoverable if filing of the
lottery application is made impossible by any events beyond
the control of usavis.org (For example,
including but not limited to cancellation of the Lottery Visa program by the US Government, Act of War, Acts of Nature,
Legislative or procedural change and/or State Action). You
acknowledge that you will not submit duplicate applications
and usavis.org will not be responsible for
any such submissions. The Government does not have a fee for
entering the DV Lottery. usavis.org is a
private company and if you select to hire usavis.org
services to submit your application your fee will be applied
towards covering usavis.org 's costs and
time in handling and submitting your application.
By submitting your application and payment to
usavis.org you understand and agree to the
refund policy specified herein.
No guarantee of win
You understand that this application is a Lottery and not a
guarantee of winning. Applications submitted correctly to
usavis.org receive an equal opportunity. A
computer will randomly select eligible entrants. Choosing
usavis.org service does not guarantee a better
or expedited handling.
The eligibility requirements have been
detailed and listed on this web page. It is up to you to
review the requirements and ensure that you qualify within the

Use of service
Permitted Uses and Restrictions on Use Subject to this
Agreement, a user is granted permission to use the Services to
prepare a single valid immigration application per applicable
service fee paid and, after proper registration and any
applicable payment, and print such an immigration application.
The Services may be used only for their intended purpose, and
may not be used to prepare immigration forms, supporting
documents or letters on a professional basis (i.e., for a
immigration lawyer or other fee for immigration preparation
services).
You shall not attempt to access any other of usavis.org
's systems, programs or data that are not made available for
public use. You agree to review your immigration application
for indications of obvious errors prior to printing your
application. You are also responsible for acquiring and
maintaining all equipment, computers, software and
communications services (such as long distance phone charges)
relating to the access and use of the Services, and for all
expenses relating thereto (plus applicable INS fees). The
payment of all fees and charges to usavis.org,
if applicable, must be made by your valid credit or charge
card and/or other forms of accepted payments as specifically detailed on this site, except as
otherwise provided herein, all fees and charges are
non-refundable.
usavis.org uses a
variety of methods (e.g., in-product, Internet and phone) to
provide technical support and other program usage assistance
in connection with the Services. The terms and conditions
governing the offering of this assistance, some of which have
fees chargeable to you, are announced by usavis.org
from time-to-time. Consult usavis.org 's web
site for the most up-to-date information relating to this
assistance and any associated charges.
You are the only person authorized to use your user
identification and password, and shall not permit or allow
other persons to have access to or use the same. You are
responsible for the use of the Services under your user
identification number, and for maintaining the confidentiality
of your user identification and password. You agree to immediately notify usavis.org of any unauthorized use of your registration or password. For security
purposes, unless otherwise noted, usavis.org
will not disclose your user identification or password if you
lose or forget it, which circumstance would require you to
reenter your immigration information. Although it has taken
significant measures to ensure the security of information
submitted by you in using the Services, usavis.org
cannot guarantee the security of information collected during
your use of the Services and shall not be liable in any way
for a compromise of your data. Except to the extent required
by applicable law, usavis.org has no
obligation to store or maintain any information you provide to
it, and you agree to print or save a copy of your immigration
application for you records.
Modifications
usavis.org has the right
at any time and for any reason to modify or discontinue any
aspect or feature of the Services, including but not limited
to its content, functionality or hours of availability, the
equipment needed for its access or use, or its pricing, and neither usavis.org nor its affiliates shall have any liability thereto.
Immigration laws and regulations
Immigration laws and regulations change frequently and their
application can vary widely based upon the specific facts and
circumstances involved. Users are responsible for consulting
with their own professional immigration advisors concerning
their specific immigration circumstances. usavis.org
disclaims any responsibility for the accuracy or adequacy of
any positions taken by users in their immigration
applications. All warranties or guarantees given or made by
usavis.org with respect to the Services (1) are
for the benefit of the registered user of the Services only
and are not transferable, and (2) shall be null and void if
you breach any terms or conditions of this Agreement.
Trademark Information
The trademarks, logos and service marks ("Marks") displayed on
this Web site are the property of usavis.org
or other third parties. You are not permitted to use the Marks
without the prior written consent of usavis.org
or such third party which may own the Marks. "usavis.org"
is a registered trademark of usavis.org.
Other product and company names mentioned herein may be the
trademarks of their respective owners. Nothing contained in
these Web pages should be construed as granting or permitting
any right to use such trademarks.

Governing Law; Forum for Dispute Resolution
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Israel, without regard to the conflict of laws provisions thereof. Any dispute between the parties shall be resolved exclusively in competent courts sitting in the in Tel Aviv, Israel, and any appellate court from any thereof, with respect to any suit, action or proceeding pertaining to this Agreement. You and usavis.org hereby irrevocably consent to the exclusive jurisdiction of such courts and waive and agree not to assert any objection to the jurisdiction or convenience thereof.
Miscellaneous
usavis.org shall have
the right to immediately terminate your access to or use of
the Services in the event of any activities which are in
breach of this agreement or conduct which, in usavis.org
's judgment, interferes with the operation or use of the
Services (e.g., excessive usage of the Services which disrupts
the use of the Services by other users). Termination of this
agreement automatically terminates your license and
authorization to use and/or access Services and any content or
other material contained therein. This agreement (including
any related content on the Services, such as the introductory
and welcome pages, which by this reference are incorporated
herein) set forth usavis.org's entire
liability and your exclusive remedy with respect to the
Services, and is a complete statement of the agreement between
you and usavis.org. This agreement does not
limit any rights that usavis.org may have under trade
secret, copyright, patent or other laws. The employees of
usavis.org are not authorized to make modifications to this
agreement, or to make any additional representations,
commitments, or warranties binding on usavis.org,
except in a writing signed by an authorized officer of
usavis.org. If any provision of this Agreement is invalid
or unenforceable under applicable law, then it shall be, to
that extent, deemed omitted and the remaining provisions will
continue in full force and effect.
You should confirm that the pricing for your use of the
Services has not changed, particularly if some time has passed
between the date you start your immigration application and
the date you finish and are ready to file it.
usavis.org
is not responsible for any late filing or rejection of your
immigration application.
You agree that usavis.org is permitted to
access and use any other information provided by you to
perform the Services and, if necessary, to access such
information to obtain contact information in order to provide
notifications relating to the Services to you.
usavis.org is privately
owned and is offering application preparation services in the
areas of Immigration and Naturalization.
usavis.org is not the Immigration and
Naturalization Service (INS) or a law firm. INS does not
accept applications in electronic form or through the
Internet. If you choose, you can use usavis.org
services to prepare your application online. usavis.org
aims at making your application preparation simpler, easier,
better understandable and cost effective. usavis.org
neither intend nor claim to provide Legal advice or solutions
to individual's specific problems.
Applications received after the usavis.org
submission period as set out in the FAQ page in the Site will automatically be processed for the next
lottery.
usavis.org's web sites
uses cookies to gather and store information. Cookies are
pieces of data that a web site transfers to your computer's
hard drive solely for record-keeping purposes. Cookies help
usavis.org make its software more useful by
storing information on your preferences. There is nothing
unusual about the use of cookies by a web site and they are an
industry standard. They do not personally identify you, but
they will identify your computer. Your browser is most likely
set up to accept cookies, but you can set yours to refuse
them. If you do so, you may not be able to take full advantage
of usavis.org's web site. usavis.org
is not liable for any failure of your computer due to their
